These Terms of Use (“Terms”) govern your access to and use of Solar Cowboys’ websites, pages, forms, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy practices. If you do not agree, do not use the Services.

For purposes of these Terms, “Solar Cowboys,” “we,” “us,” or “our” means Solar Cowboys and its affiliates, contractors, and authorized partners.

What we do (for context). Solar Cowboys provides information and tools related to residential and other solar solutions, including a guided process for going solar, savings/energy-independence education, and partner/dealer programs. We may connect you with sales, design, installation, financing, or service partners. 

1) Eligibility & Account Features

You must be at least the age of majority in your jurisdiction to use the Services. Certain features (e.g., “Get a Quote,” contact forms, scheduling, partner applications) may require you to submit information. You agree to provide accurate, current information and to update it as needed.

2) Consent to Contact (Calls, Texts, Email)

By submitting a form, requesting a quote, or otherwise sharing your contact details, you consent to be contacted by Solar Cowboys and/or our authorized partners via phone call, text/SMS, email, and prerecorded/automated technology about your inquiry, products, and services. Message and data rates may apply. You can opt out of marketing texts at any time by replying STOP; opt-out does not affect transactional or service messages (e.g., appointment reminders).

3) Non-Advice; Estimates & Availability

Information on the Services is for general informational purposes only; it is not legal, financial, engineering, or professional advice. Any savings projections, production estimates, timelines, incentives, interconnection approvals, utility rates, and tax outcomes are not guarantees and may vary by location, equipment, usage, weather, utility/market changes, permitting, and other factors.

4) Third-Party Partners & Installers

We may introduce or refer you to independent third parties (e.g., sales dealers, installation providers, financing companies, warranty administrators). Those third parties are solely responsible for their services, terms, warranties, pricing, credit decisions, workmanship, and schedules. Your relationship with any third party is governed by that party’s agreement(s). We do not control and are not responsible for third-party acts or omissions.

5) User Conduct

You agree not to:

  • Violate any applicable law or regulation;

  • Interfere with or disrupt the Services or related networks;

  • Use bots, scrapers, or similar tools to access or extract data from the Services without written permission;

  • Post, transmit, or submit anything unlawful, misleading, infringing, or harmful;

  • Attempt to bypass security or access non-public areas.

We may suspend or terminate access for violations.

6) Intellectual Property

The Services and all content therein (including text, graphics, logos, icons, images, software, and compilations) are owned by Solar Cowboys or our licensors and are protected by intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. All rights not expressly granted are reserved.

You may not copy, modify, distribute, display, perform, create derivative works from, or exploit any part of the Services without our prior written consent.

7) Reviews, Submissions, & Feedback

If you submit content (e.g., reviews, testimonials, questions, comments, ideas, or materials), you represent that you have the right to do so, that it’s accurate, and that it doesn’t infringe others’ rights. You grant Solar Cowboys a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish, translate, and display such content in connection with the Services and our business (including marketing and re-posting, with or without attribution), consistent with applicable law.

8) Privacy

9) Promotions & Referral Programs

From time to time, we may offer promotions, events, or referral programs with additional rules, eligibility requirements, or limitations. Those terms are incorporated by reference and will be controlled in the event of a conflict.

10) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOLAR COWBOYS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any content is current, complete, or accurate.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SOLAR COWBOYS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA; OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US (IF ANY) FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT—WHICHEVER IS GREATER.

Some jurisdictions do not allow certain disclaimers or limits; portions of this section may not apply to you.

12) Indemnification

You will indemnify, defend, and hold harmless Solar Cowboys and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Services; (b) your violation of these Terms; or (c) your violation of any law or third-party right.

13) Changes to the Services & Terms

We may modify or discontinue any part of the Services at any time. We may also update these Terms from time to time. Changes are effective when posted to the site (or when we otherwise notify you). Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

14) Termination

We may suspend or terminate your access to the Services at any time for any or no reason, including if we reasonably believe you violated these Terms. Upon termination, sections that by their nature should survive (e.g., IP, disclaimers, limitations, indemnity, dispute resolution) will survive.

15) Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or relating to them or the Services are governed by the laws of the State of Utah, without regard to conflict-of-law principles. You and Solar Cowboys agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in Utah County, Utah, for matters not subject to arbitration.

Arbitration & Class Action Waiver. At our sole option, any dispute may be resolved by binding individual arbitration under the rules of a recognized arbitration provider. YOU AND SOLAR COWBOYS AGREE THAT CLAIMS MAY ONLY BE BROUGHT IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16) International Users

We operate the Services from the United States and make no representation that they are appropriate or available for use elsewhere. Accessing the Services from territories where the content or practices are illegal is prohibited.

17) Severability; Entire Agreement; No Waiver

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. These Terms constitute the entire agreement between you and Solar Cowboys regarding the Services and supersede any prior or contemporaneous understandings. Our failure to enforce any provision is not a waiver.
